A contested divorce often creates one, as filings and written statements submitted to the court are public record, while negotiations that take place through collaborative divorce and mediation occur behind closed doors. The only record is what is ultimately submitted with the final paperwork, which can also be shielded from the public by filing a Separation Contract under seal (meaning only the parties involved have access). For many clients, privacy is a meaningful factor in choosing a private settlement process.
